1. Introduction

Welcome to Luthieri! By accessing our platform (Luthieri.com), you agree to these Terms & Conditions. Please read them carefully. If you do not agree, please refrain from using our services.

2. Definitions

• Platform: Luthieri.com, including any services, tools, and features provided.
• User: Any individual using the platform, whether as a musician, luthier, or other.
• Luthier: A registered individual or business specializing in creating or repairing stringed instruments.
• Musician: An individual seeking to purchase instruments, bows, or services listed by luthiers.

3. Platform Purpose and Services

Luthieri UG connects musicians with luthiers based in the European Union (EU) who list instruments, bows, and services. Luthieri UG does not act as a broker, agent, or representative in transactions. All arrangements, including payments and terms of sale, are managed directly between musicians and luthiers.

4. Account Registration and Responsibilities

4.1 Musicians

Musicians may create a free account on the platform to contact luthiers, access instrument and bow details, and leave reviews.

4.2 Luthiers

Luthiers may create accounts upon approval by Luthieri UG, following a selection process. Listings are subject to a subscription fee, payable monthly or annually. Luthieri UG reserves the right to suspend or terminate accounts that do not meet platform standards or breach these terms.

4.3 Account Security

All users are responsible for maintaining the confidentiality of their account credentials and for any activity under their account. Users agree to notify Luthieri UG of any unauthorized access or breach immediately.

5. Luthier Listings and Optional Listing Support

5.1 Listing Requirements

Luthiers are responsible for the accuracy of all details and images provided in their listings. Luthieri UG reserves the right to moderate and, if necessary, request changes to listings to meet platform standards.

5.2 Optional Listing Support

For an additional fee, Luthieri UG offers an on-site service to assist luthiers with listing creation. This service includes professional photography and assistance in drafting details about instruments or bows. For pricing and arrangements, luthiers can contact Luthieri UG.

6. Reviews

6.1 Eligibility

Only musicians who have interacted with a luthier through the platform may leave a review.

6.2 Moderation

Luthieri UG moderates all reviews to ensure they meet standards of genuineness and constructiveness. Luthiers may request a review for reconsideration if they believe it is inaccurate or unfair.

6.3 Integrity of Reviews

All users agree not to manipulate, fabricate, or otherwise interfere with the review process. Any violation may result in account suspension.

7. Payment Processing

7.1 Subscription Fees

Luthiers are responsible for paying monthly or annual subscription fees for listing services. Payment is processed via Stripe, and payment terms and conditions are governed by Stripe’s policies.

7.2 Non-Refundable

Subscription fees are non-refundable, except in cases where Luthieri UG may decide otherwise at its discretion.

8. Third-Party Services and Integrations

8.1 Video Integration

Luthieri UG allows luthiers to link videos from YouTube and Vimeo to their listings. All users must comply with the terms of YouTube and Vimeo regarding video content.

8.2 Payment Provider Integration

Luthieri UG uses Stripe for subscription payment processing. By using this feature, users agree to comply with Stripe’s Terms & Conditions and Privacy Policy.

9. Intellectual Property Rights

All content provided on Luthieri UG, including but not limited to text, images, and logos, is the property of Luthieri UG or its users and is protected under applicable intellectual property laws. Users may not copy, distribute, or use any content without permission from Luthieri UG or the respective rights holder.

10. Data Storage and Security

Luthieri UG uses Amazon Web Services (AWS) for data storage. We implement industry-standard security measures in compliance with the EU’s General Data Protection Regulation (GDPR) to protect users’ personal data. See our Privacy Policy for full details.

11. Limitation of Liability

Luthieri UG is a platform for listing and connecting musicians and luthiers; it is not responsible for any agreements, transactions, or interactions made between users. Luthieri UG shall not be liable for any damages arising from use or inability to use the platform.

12. Termination of Services

Luthieri UG reserves the right to suspend or terminate accounts that violate these Terms & Conditions or engage in fraudulent or harmful behavior.

13. Governing Law and Disputes

These Terms & Conditions are governed by EU laws. Any disputes will be resolved through arbitration, unless required otherwise by applicable law.
